This significant new work was first published in 2009. It was produced by the author Donald J. M. Brown, Q.C. after ten years of devoted effort. Civil Appeals represents the synthesis of a lifetime of practice and teaching in the field of appellate law. We believe this publication will become an important asset to the civil litigation bar and appellate courts in Canada and will be a useful reference for appellate courts, barristers and appellate court practitioners in other common law jurisdictions.
This unique publication is an in-depth presentation of the law as it pertains to the issues that arise in the appeal process before the appellate courts of Canada.
It organizes, analyses and sets out the case law in the area in a manner that, to our knowledge, has not been done before. It is designed to function as a comprehensive research and working tool for the knowledgeable civil litigation practitioner. It will also be of invaluable assistance to legal scholars who are students of the litigation process and the actions of the Canadian Appellate Courts.
The book is organized into four sections. Part 1 deals with the JURISDICTION OF THE APPELLATE COURTS in Canada and is covered in Chapters 2 through 6. Part 2 covers the APPELLATE PROCESS and is discussed in Chapters 7 to 10. In the third section, which includes Chapters 11 to 13, the subject matter is TRIAL SUPERVISION . Chapters 14 to 16 considers APPELLATE REVIEW OF THE MERITS. The table of contents is more than 50 pages in length.
